How can the Habari, ASL2 licensed theme (including images) be converted into a WordPress theme whose images (which are bit-for-bit identical) which is licensed under a CC license?

Equally, the “license” for the WP port says it can only be used for non-commercial use and the link remain intact, which goes against the GPL/CC licensing of it.
